I've been looking into using images from stock sites(because I suck at design) but the license is confusing. Does the iPhone game count as digital distribution? If that's the case then you can't sell more than 200k or so without the additional license. Not that I'm worried about selling 200k but that license stuff is confusing and I would hate to release a game with stock images just to have them come after me for it.
Who uses stock images for their games?

Very good question. I've used stock photos in other iPhone apps but, as you said, I haven't ever come close to 200,000 installs so it hasn't been an issue.
I am not a lawyer, though... :)

I would recommend you start by emailing them to ask about your specific situation. If they don't respond promptly with favorable information, then you should look for another stock image provider.

I've not used one in a game. But I do sell stock images.
If you're certain you wont sell more than 200k just get the standard license. If you're lucky enough to sell more than 200k just buy the extended license afterwards? Can't see them having a problem with that.

Hi! I am the Creative Director at http://www.cutcaster.com. I can tell you that our site (and most others) would consider inclusion in a game as a derivative product. As long as you are not selling the background or texture as a product, you could use it in that way.
