I'm sure it's similar but it's not the same. I love playing Tiny Tower but it wasn't the first tower/building simulation and won't be the last. I'm sure Zynga was intending to make it very close yet different because that's they're MO. It's been a recipe for success for them. I'd hate to live in a world where people weren't allowed to at least try to improve upon what someone else did. Still, I hope they did just that, improve upon it. Hopefully, both will do well. Not really into how Zynga does business. If rolls were reversed, something tells me there would be attorneys involved already.

Has everyone forgot one of the good games from the past called Sim Tower....
Tiny Tower is like a clone of that as well....Angry Birds is a clone of Crash the castle games....
Name of word is will your game catch? Marketing?
Most games are similar with a twist...

Just to add my opinion, i'm very jealous of who develop a new gameplay, they are legends for me. I'm less jealous of who make a clone better than the original because i think it's a bit too simple to enhance things, especially if you have a lot of money.
Enhancing a car is simple: make it nicer, faster, more comfortable, etc..
Enhancing a game is the same: better graphic, a cool and well paid music and more dragons… it's too simple if you have money to invest.
But, from the customer point of view, a better car and a better game are not that bad…
I no longer play Tribes but glory to the inventors of the multiplayer team games! All those legendary developers are never forget but they cant pretend that their game aren't cloned because are the same customers who wanted this to happen.

Nature of the beast, http://imgur.com/ajaYt says it all really. If you have a successful game you will catch the eye of others, there are plenty of clones of the top games most of them you never see as they are generally crap and stand no chance of eclipsing the 'original'.
In this case it's a game model that is ideal for someone like Zynga, they also have the resources and budget to eclipse the original.
In the world of Freemium apps there is very little loyalty to established brands.

The internet is the internet, and my opinion is, that whatever you make public to half the world, half the world should be allowed to use to whatever they desire.
Any game idea, any image, and any song, you can find on the internet, you should be allowed to use in whatever project you have. That is my belief.Used for inspiration maybe, but not for profiting off the back off. Would it be cool for me to make a game and use a song someone else has made in that game (without me giving anything to them)? No.
You've also got to look at this from a customers point of view. If I were to start using the same avatar image your using on this forum, would it confuse people? Maybe. Probably only for a few milliseconds but my action of doing that hurts both you and me in the eyes of the customer as they don't like confusion.
General comment time:
Zynga may be the worst kind of games developer but they do have a right to draw inspiration from wherever they want to create whatever they want. That said, this is VERY close to Tiny Tower so in my mind, it's a rip-off. Had they changed the general style and dynamics a little then it wouldn't be so bad, but they've done the least amount possible to release this game.
I don't know what the legal stance is but ethically, this is just awful. Personally I could never let myself release something that is so close to another game, not just because it's morally grey but because that game is then nothing to do with me. It's got none of my personality in it and that's just depressing. Just like the XFactor winners get to release a song which is nothing more than a cover song stripped of all character, Zynga have released this. It makes me sad.
